This Privacy Policy describes how PitchWell LLC and its affiliates and related entities (collectively, "PitchWell," "Company," "we," or "us") collect, use, and disclose personal information of visitors and subscribers who access or interact with our website at gopitchwell.com (the "Website") and the Company's software, products, hosting, services, sales, marketing, and all related components and documentation, and all content, functionality, updates, and revisions thereto (collectively, the "Services"). California law requires us to post a privacy policy that identifies the categories of personally identifiable information we collect, the categories of third parties with whom we may share that information, and certain other information about our privacy practices. This Privacy Policy provides that information.

This Privacy Policy applies to your use of the Website and Services. It does not apply to information collected offline or by any third party, including through any application, integration, or content that may link to or be accessible from the Website. By accessing or using the Website or Services, you agree to this Privacy Policy.

1. Information We Collect

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household ("personal information"). Personal information does not include publicly available information, lawfully obtained information that is a matter of public concern, or deidentified or aggregated information. We collect the following categories:

  • Identifiers and contact information (name, preferred name, pronouns, email, telephone, and the contents of your communications with us).
  • Account and profile information (profile details, biography, achievements, interests, background, and writing samples subscribers provide to set up and personalize the Services).
  • Content you provide (pitch content, outreach messages, templates, and other materials you create, upload, or transmit).
  • Payment information, collected and processed by our payment processor (Stripe); we do not receive or store full card numbers.
  • Google account information for subscribers who connect a Google account (name, profile picture, language preference, primary email, and Google account identifier), obtained through Google OAuth — see Section 4.
  • Internet and device activity information collected automatically (IP address, browser type/ID, domain, referring address, operating system, device category, screen resolution, and usage information such as pages visited and session duration).

The Website and Services are not intended for, and are not directed to, children under 18, and no one under 18 may provide any information to or through them. We do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13 without verifiable parental consent, we will delete it in accordance with applicable law. If you believe we may have information from or about a child under 13, please contact us at admin@gopitchwell.com.

2. Sources of Personal Information

We obtain personal information directly from you (when you register, set up or personalize your profile, subscribe to or purchase the Services, create or send content, or contact us); indirectly from you (from your interactions with the Website and Services); from our service providers (such as analytics providers and our payment processor); and from Google, for subscribers who connect a Google account through Google OAuth (see Section 4).

3. How We Use Personal Information

We use and disclose the personal information we collect to: provide, operate, maintain, and improve the Website and Services; create and administer your account; provide the subscriber features described in Section 4 (AI-assisted drafting, media targeting, scheduling, and outreach analytics); process payments and manage subscriptions, billing, and renewals; communicate with you and respond to your requests; send marketing communications subject to your choices and applicable law; personalize your experience and conduct research, testing, and analytics; prevent and address fraud, security incidents, and policy violations; protect the Company, our users, and our operations; and comply with applicable laws — and for any other purpose with your consent or as described to you at collection.

4. Subscriber Services, Integrations, and Billing

This Section describes additional collection, use, and disclosure that applies when you are a paid subscriber ("Subscriber"). PitchWell uses commercially reasonable efforts to ensure any use and transfer of Subscriber information received from Google APIs ("Google user data") complies with the Google API Services User Data Policy, Google APIs Terms of Service, and the Google Workspace user data and developer policy (collectively, "Google Policies").

Services we provide to Subscribers include the following: Gmail integration (via Google OAuth) to send pitch emails from the Subscriber's own email address; AI-assisted drafting; a media database of podcasts and outlets with contact targeting; a personalized writing persona built from writing samples the Subscriber uploads; profile setup and history; scheduling and follow-up management; and open tracking and analytics on outreach emails.

To provide the Services to Subscribers, each Subscriber authorizes PitchWell to:

  • access the Subscriber's Google profile information, primary email address, Google account identifier, and Gmail account for the sole purpose of providing the Services. The Subscriber always initiates and controls each send; PitchWell does not send email autonomously or on the Subscriber's behalf.
  • transmit the content the Subscriber provides us (such as pitch content, writing samples, biography, achievements) to third-party AI/LLM providers acting as our service providers, solely to provide the Services, including, without limitation, generating content at the Subscriber's direction. PitchWell uses commercially reasonable efforts to ensure such service providers' use of Subscriber's Google user data complies with Google Policies.
  • provide open tracking and analytics on the outreach emails sent by the Subscriber. To provide open-tracking features to our Subscribers, we embed a tracking pixel in emails that Subscribers choose to track. When a recipient opens a tracked email, we collect: the recipient's email address; whether and when the email was opened; and the recipient's device type and browser type. We use this information to show the sending Subscriber whether their email was opened, and to operate, secure, and improve our Services. We disclose it to the Subscriber who sent the email. We do not sell recipient information or share it across Subscribers, and we do not use it to build profiles of recipients. Recipients — even if they have no PitchWell account — may contact us at admin@gopitchwell.com.

We use and transfer Google user data only to provide and improve these user-facing features and other purposes permitted under this Privacy Policy, the Google Policies, and applicable law. Subscribers may revoke PitchWell's access at any time through their Google account security settings or by disconnecting the integration within the Services, and we will delete or cease using the associated Google user data except as required by law.

Payments are processed by our third-party payment processor, Stripe, and are subject to Stripe's own terms and privacy policy. Subscribers provide their payment information directly to Stripe; PitchWell does not collect or store a Subscriber's full payment card number and receives only limited transaction details (such as confirmation of payment, the last four digits of the card used, and billing information) needed to manage the subscription, billing, and renewals for each Subscriber. Stripe maintains its own security and PCI-DSS compliance measures for the payment information it processes.

Stripe and any other third-party payment processors are independent entities that we do not operate or control, and their collection, use, storage, and protection of Subscriber payment information are governed solely by their own terms and privacy policies. To the fullest extent permitted by applicable law, PitchWell is not responsible or liable for the acts, omissions, security practices, data handling, or performance of any third-party payment processor, including any unauthorized access to, loss of, or misuse of payment information while in the possession or control of such processor. We encourage Subscribers to review the applicable processor's terms and privacy policy before submitting their payment information.

5. Retention of Personal Information

We retain your personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer period is required or permitted by law. Criteria include whether we need the information to provide the Services, whether you have an active account or subscription, whether we have a legal obligation to retain it, and whether we have another legitimate business purpose.

6. How We Disclose Personal Information

We do not sell your personal information, and we do not share it with third parties for cross-context behavioral advertising. We may disclose personal information to service providers and contractors, such as for hosting, analytics, and payment processing, who are bound to confidentiality and to use your personal information only to provide services to us, as required by applicable law, or with your consent or at your direction.

7. How We Protect Your Personal Information

We implement and maintain reasonable administrative, physical, and technical security procedures and practices appropriate to the nature of the information, designed to protect it from unauthorized access, destruction, use, modification, or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Any transmission of personal information is at your own risk, and you are responsible for protecting your account credentials.

8. Cookies and Tracking Technologies

We and our third-party service providers use cookies and similar tracking technologies to operate the Website, remember your preferences, secure the Services, and gather usage and performance statistics. The analytics and tracking technologies we use include Google Analytics, Microsoft Clarity, and PostHog. These providers may use cookies, unique identifiers, beacons, and similar technologies to collect information about your use of the Website. Most browsers accept cookies by default, but you can usually change your settings to refuse or delete them; if you disable cookies, some features may not function properly.

9. Do Not Track Signals and Third-Party Tracking

Do Not Track ("DNT") is a browser setting signaling that a user does not want their online activity tracked across third-party sites over time. We do not currently respond to DNT signals or similar mechanisms. Third parties, such as our analytics providers, may collect information about your online activities over time and across different websites when you use our Website; we do not control their tracking technologies, and we encourage you to review their privacy policies.

10. Links to Third-Party Websites and Services

The Website and Services may link to or integrate with third-party websites and services that PitchWell does not operate or control. These third parties have their own privacy policies, and we are not responsible for their content or practices. We encourage you to review their privacy policies before submitting information to them.

11. Your California Privacy Rights and How to Review or Change Your Information

California's 'Shine the Light' law permits California residents with an established business relationship to request information about our disclosure of personal information to third parties for those third parties' own direct marketing purposes. PitchWell does not disclose personal information to third parties for those third parties' direct marketing purposes. If our practices change, we will update this policy and provide the disclosures or opt-out required by law.

Reviewing or changing your information: to review, correct, update, or request deletion of the personal information we have collected, contact us at admin@gopitchwell.com with sufficient detail for us to evaluate and respond. We may take reasonable steps to verify your identity and may decline where permitted or required by law.

12. Other State Privacy Rights

Depending on where you live, other state consumer privacy laws may provide rights regarding your personal information, including to confirm, access, correct, delete, or obtain a portable copy of it, and to opt out of processing for targeted advertising, sale, or certain profiling. PitchWell does not sell personal information or use it for targeted advertising or such profiling. To exercise any right that applies to you, contact us at admin@gopitchwell.com. We will not discriminate against you for exercising any privacy right.

13. Changes to This Privacy Policy

We reserve the right to update this Privacy Policy at any time. If we make material changes, we will update the "Last Updated" date and post the updated policy on the Website, and where required notify you by email or a notice on the Website. We encourage you to review this Privacy Policy periodically.
